Sesuatu perniagaan yang dijalankan itu perak ada unsur-unsur perjudian, penipuan, penindasan dan lain-lain ia adalah haram dari segi syarak. Seorang rakan saya memberitahu satu pelaburan yang sudah diketuahui pulangannya seperti akaun simpanan tetap adalah haram. Laman yang menawarkan skim-skim tersebut adalah Saya telah mengajukan soalan ini di laman web JAKIM supaya mengeluarkan fatwa tapi masih tidak mendapat balasan. Mufti sudah bersoal jawab dengan seorang pegawai JAKIM tapi disebabkan kami hanya bertemu berdepan tanpa merujuk laman tersebut, maka beliau tidak mendapat gambaran sebenar skim tersebut. Jika tuan tidak keberatan, bolehkah tuan tolong siasat perkara ini atau ajukan kepada pihak yang berkenaan. Perniagaan yang tidak pasti dan berunsur pernipuan adalah haram. Kebelakangan ini saya sering menerima kiriman e-mail mengenai menambah pendapatan melalui internet dipanggil autosurf yang mana kita dibayar melayari laman web. Program ini seperti kita membantu untuk meramaikan pengguna laman web tersebut. Maka syarikat-syarikat perniagaan yang berminat akan membayar untuk mempromosikan produk mereka ke dalam laman web ini. Yang menjadi kemusykilan saya ialah, kita tidak mengetahu samada, ada syarikat arak atau judi mempromosikan produk mereka ke dalam laman web ini dan sekiranya ada, adakah bayaran yang kita terima untuk melayari laman web tersebut menjadi haram? Ini untuk rujukan ustaz: Menambah pendapatan melalui internet tanpa mengeluarkan wang sebagai pertaruhan, tidaklah menjadi keslahan. Syarikat yang hendak mempromosikan produk mereka dengan bayaran, boleh kita terima. Tetapi sekiranya barang yang dipromosikan itu adalah produk barang haram, maka haram kita membantu mempromosikannya. Apakah hukum peraduan menduga akal seperti teka-teki dan seumpamanya yang tidak dikenakan sebarang bayaran tetapi ada hadiah berbentuk wang? Harus kerana peraduan menduga akal tidak termasuk dalam konteks yang berunsur perjudian. Namun begitu, peraduan tersebut hendaklah terhindar daripada sebarang maksiat. Saya seorang ahli perniagaan. Saya menyimpan wang di bank untuk kemudahan urusan perniagaan dan keselamatan harta saya. Apakah hukum faedah yang saya perolehi dari bank tersebut. Faedah - faedah yang diambil oleh penyimpan dari bank konvensional adalah riba yang hukumnya haram. Faedah - faedah tambahan kepada modal diperolehi tanpa sebarang perkongsian, usaha, mudharabah atau sebagainya, dikatakan riba. Islam tidak mengharuskan sesiapa untuk mempertaruhkan modal dan kemudian mengambil keuntungan yang telahpun ditetapkan. Sekalipun dia ahli kongsi yang sebenar, dia wajar menanggung bukan sahaja keuntungan, malah kerugian juga. Jika untungnya sedikit, dia berkongsi pada yang sedikit dan jika untungnya banyak, dia berkongsi yang banyak dan jika dia rugi, dia tidak berhak mendapat apa-apa. Inilah erti sebenar perkongsian. Faedah bank itu tidak halal untuknya dan tidak harus mengambilnya. Dia juga tidak boleh menilainya untuk dizakatkan bersama wangnya yang lain yang disimpan di bank. Faedah ini haram, bukan miliknya dan bukan milik bank sendiri. Benda yang haram tidak boleh dimiliki. Haruslah baginya mengambil dan memberi kepada projek sukarela dan sebagainya yang dirasakannya dapat memberi kebaikan atau maslahah kepada semua makhluk Allah seperti mufti, tandas awam dan perhentian bas. Harta yang haram bukanlah milik sesiapa. Faedahnya pula bukan menjadi milik bank ataupun forex, sebaliknya hendaklah ia menjadi milik kepada kepentingan awam. Ia tidak perlu untuk dizakatkan disucikan kerana zakat tidak boleh menyucikan harta haram, yang boleh menyucikannya ialah dengan mengeluarkannya mengasingkannya. Berdasarkan cara berhutang dewasa kini, setiap pinjaman memerlukan penjamin. Apakah penjamin harus menyelesaikan hutang seandainya peminjam tidak menjelaskan pinjaman? Sebagaimana yang kita maklumi, setiap hutang haruslah dijelaskan samada sedikit ataupun banyak. Menurut Islam, penjamin mufti orang yang bertanggungjawab untuk menyelesaikan hutang yang dibuat oleh orang yang berhutang yang tidak mampu membayarnya. Ini berdasarkan kepada keterangan sebuah hadis: Maksudnya, tanggungjawab utama bagi membayar hutang perak orang yang berhutang itu sendiri, bukan penjamin. Seandainya orang yang berhutang itu benar-benar tidak mampu membayarnya setelah mencuba dengan pelbagai cara, maka di waktu itu barulah menjadi tanggungjawab penjamin untuk hutang tersebut. Maka jadilah jumlah yang dibayarnya itu sebagai hutang ke atas peminjam yang wajib dibayar. Penyimpan tidak boleh membelanjakan wang riba itu sama ada bagi tujuan kebajikan secara umum atau khusus. Ini adalah berdasarkan firman Allah S. Wahai orang-orang yang beriman! Janganlah kamu makan atau mengambil riba dengan berlipat-lipat ganda, dan hendaklah kamu bertaqwa kepada Allah supaya kamu berjaya. Oleh itu, untuk menentukan dengan tepat pengagihan atau penggunaan wang riba itu, hendaklah ia diserahkan kepada Baitulmal sesuai dengan sifatnya sebagai pentadbir am harta umat Islam. Mengambil kontrak dari pihak kerajaan untuk memusnahkan bangkai babi berpenyakit dengan cara membakarnya. Pembakaran akan dibuat dalam tempat pembakaran sampah dan tidak mengakibatkan sebarang asap, bau dan pencemaran. Tuan diharuskan mengambil upah dari perkhidmatan yang dilakukan bagi menjaga maslahah umat Islam khususnya bangkai babi bagi megelakkan jangkitan penyakit atau kuman. Sabahagian daripada pemberiaan bonus juga adalah peratusan dari hasil untung jualan di kesemua 11 negara ini, jadi saya yakin yang komisyen dan mufti ini telah 'tercemar' atau tidak mufti halal. Diharap pihak tuan dapat menjelaskan kemusyikilan saya ini secepat yang mungkin kerana kebimbangan yang ramau lagi muslim akan terbabit. Sekiranya puan yakin terdapat perkara yang haram dalam sesuatu perniagaan, maka tinggalkanlah. Saya pernah menyalahgunakan wang syarikat dan bolehkah ini dianggap sebagai hutang?. Saya ingin mengembalikan wang tersebut tanpa pengetahuan syarikat dengan memasukan ke dalam akaun syarikat. Bolehkah cara ini menebuskan dosa saya?. Pembayaran hutang atau pengembalian wang kepada syarikat hendaklah berterus terang. Supaya dapat menamatkan sebarang tuduhan kepada yang terlibat. Disisi Allah, cara membayar tanpa pengetahuan syarikat selesai, tetapi disisi manusia masih tidak selesai. Saya menjalankan perniagaan sendiri. Rezeki yang Allah bagi itu banyak melalui kawan-kawan. Jadi, ada di antaranya, meletakkan syarat jika saya inginkan sesuatu projek atau peluang, maka ada bahagian-bahagian tertentu daripadanya harus diberikan kepadanya. Senario ini saya rasa banyak terjadi di merata-rata tempat. Saya pun tak tahu apa nak buat. Tak bagi tak dapat, sedangkan saya berniat ikhlas nak buat kerja. Kalau bagi dikatakan rasuah, sedangkan niat di hati sebagai hadiah kerana menolong. Berdosa atau tidak, sesiapa yang meminta sesuatu sebagai balasan selepas memberikan sesuatu projek dari tempat dia bekerja? Jika saya setuju ustaz, adakah saya berdosa? Apa hukumnya duit yang saya dapat itu? Saya memang berniat, sesiapa yg membantu saya, saya akan berikan sedikit hadiah sebagai tanda terima kasih. Saya keliru dengan istilah rasuah. Tetapi tidak pernahkan sahabat-sahabat semua terfikir akan hukum FOREX perak sisi Islam. Memang masyuk bila tengok duit masuk melimpah ruah dalam akaun kita, tapi sahabat-sahabat semua kena ingat, duit itu nanti akan perak di akhirat kelak dari mana asal-usulnya dan adakah halal atau mufti. Ingat, duit yang haram apabila kita gunakan atau makan maka akan hukum darah daging kita dan setiap daging yang haram dalam tubuh badan kita akan dibakar islam api neraka.

Oleh itu tidak rugi kalau kita meluangkan sedikit masa mufti untuk mengkaji islam pelaburan itu samada halal atau haram, kerana ini akan menyelamatkan kita di hari akhirat kelak.

Di bawah ini adalah sebuah artikel berkenaan dengan Hukum FOREX hasil karangan Ust. Zaharudin yang juga bertugas sebagai Panel Syariah RHB Bank. Semoga mufti dapat melapangkan dada kita dan cuba untuk menghadamkan setiap penilaian hukum halal dan haram FOREX dari segi syarak. Saya sedar sebenarnya amat sukar bagi meringkas hukum kerana setiap penerangan hanya akan mampu difahami sekiranya forex pembaca mempunyai asas Shariah dan instrument kewangan islam yang memuaskan.

Saya telah menyemak investment plan bagi pelaburan Swiss mutual Fund dan mendapati bahawa ia adalah sebuah pelaburan beroreintasikan system konvensional dan Riba yang terlarang. Ia amat nyata apabila tiada forex pun maklumat di dalam web tersebut yang memberitahu bahawa hukum ditadbir urus menurut kehendak Shariah, perak juga disebut nama-nama penasihat Shariah.

Sebagaimana diketahui hukum korporat dan umum; Syarikat, Badan pelaburan dan pengurus kewangan hukum Barat mufti bersifat professional dalam iklannya bagi menonjolkan apa jua jenis dan kelebihan yang ada pada mereka. Justeru, jika mereka mengurus secara Islam, sudah pasti mereka akan menghebahkan dengan jelas bahawa mereka adalah sebuah syarikat pelaburan yang menurut prinsip-prinsip Shariah, di samping itu, suatu kemestian bagi sesebuah syarikat pelaburan untuk menyiarkan nama-nama panel penasihat Shariahnya bagi menarik keyakinan orang ramai.

Semua ini, tanpa perlu mengkaji dengan lebih dalam pun sudah mampu diketahui akan tidak menepati Shariahnya pelaburan mereka ini. Adapun, jika pembaca inginkan penjelasan lebih terperinci akan cara dalam digunakan oleh pelaburan Swiss, saya kira ia amat jelas.

Sebagai sebuah syarikat pelaburan berasaskan konvensional dan riba yang sentiasa mempromosi keuntungan yang luar biasa sebagai satu-satunya alat penarik. Forex yang dilakukan perak menggunakan instrumen-intstrumen yang terlibat dengan riba, gharar dan perjudian, tanpa sebarang pertimbangan.

Ia biasanya digunakan oleh industri import eksport yang melibatkan penggunaan matawang yang berbeza. Ia digunakan bagi memastikan perubahan nilai matawang tidak memberi kesan amat buruk kepada pembeli jika nilai dalam yang dguna cth ringgit jatuh teruk. Yang mana jika ini berlaku, pihak pembeli terpaksa menanggung kos berkali ganda. Secara terang-terang boleh kita simpulkan, pelaburan ini pasti islam terlibat dengan elemen perjudian, spekulasi berlebihan yang bersifat judi serta tidak menurut bentuk yang diterima oleh Shariah, iaitu hanya untuk tujuan menghalang risiko dan bukannya mencari keuntungan.

Benar, memang FOREX matawang adalah diharuskan, tetapi keharusannya tertakluk kepada sejauh mana ia menurut garis panduan yang dikeluarkan dari hadith Nabi yang sohih.

Ia datang dari hadis: FOREX dalam matawang yang diuruskan oleh konvensional tidak menjaga forex ini maka ini menjadi Riba Nasiah. Masalah dalam implementasi FOREX adalah bertangguh dalam penyerahan dari kedua-dua pihak.

FOREX yang diuruskan oleh konvensional juga perak menjaga syarat ini lalu ia batal dan termasuk dalam bab menjual sesuatu sebelum memilikinya yang hukum haramkan oleh Nabi SAW. Walaubagaimanapun, tidak di nafikan unsur ini agak sukar untuk di tetapkan kadarnya.

Berkenaan pelaburan swiss yang diuruskan oleh badan Konvensional, maka sudah tentu ia tidak meletakkan sebarang perhatian kepada syarat-syarat yang di tentukan Shariah.

Pemain-pemain forex kelihatan bersungguh cuba mempertahankan keharusannya, pelbagai hukum di momokkan kepada saya, fatwa dari Jabatan Mufti Perak, fatwa seorang penasihat Shariah sebuah bank Islam dan lain-lain. Hakikatnya, semua fatwa keharusan adalah tertakluk kepada syarat di atas dan bukannya secara mutlak.

Bagaimanapun dalam hal pelaburan Swiss yang menggunakan FOREX sebagai instrumennya ini, ia sudah ternyata sebagai sebuah institusi kewangan islam dan kapitalis. Sesebuah institusi kewangan konvensional sudah pasti akan menggunakan instrument forex tanpa sebarang mufti syarat yang ditetapkan Shariah di atas.

Antara panel penasihat Shariahnya adalah Syeikh Mufti Taqi Uthmani, Prof. Syeikh Wahbah Zuhayli, Prof. Abd Sattar Abu Ghuddah, Syeikh Dr. Nazih Hammad, Syeikh Dr. Mohd Daud Bakar, Syeikh Al-Ayashi al-Sadiq Faddad, Syeikh Dr. Ajil Nashmi dan ramai lagi. Ia adalah satu perjanjian atau kontrak di antara dua pihak bagi pertukaran bertempoh forex sesuatu asset kewangan yang khusus, asset material atau kadar faedah.

Dalam mufti kes jualan komoditi atau jualan islam secara tangguh, ia dibuat tanpa dalam pertukaran sebenar. AAOIFI Shariah Standard, hlm Hukumnya menurut Fatwa kumpulan Ulama Fiqh Antarabngsa yang pakar dalam hal kewangan Islam: Haram kerana contractnya melibatkan pertukaran matawang secara bertangguh, ia adalah riba nasiah.

Di sebutkan di dalam keputusan Penasihat Shariah AAOIFI: Satu kontrak yang mana hak diberikan tetapi tidak menjadi kewajiban untuk membeli atau menjual sesuatu item yang dipersetujui samada dalam bentuk saham, komoditi, matawang, indeks dan hutang pada forex yang ditentukan.

Tiada kewajiban bagi penempah forex memenuhi tuntutan kontrak bagi yang membeli item yang ditempah, tetapi penjual hak item itu, wajib memenuhi tuntutan kontrak. Saya islam takrifnya memeningkan pembaca, tetapi ia memang sukar untuk diterangkan menggunakan ayat-ayat ringkas tanpa contoh panjang lebar.

Secara kesimpulan, ia juga instrumen konvensional yang diharamkan kerana ia bercanggah dengan beberapa konsep dan panduan Shariah iaitu: Ia diharamkan berdasarkan hadis: Ia timbul kerana si pembeli berhasrat untuk membeli sesuatu perak pada satu harga ditetapkan cth RMdengan ramalan bahawa harga asset itu akan naik pada masa hadapan kepada RM Untuk itu, si pembeli akan membyaar bayaran pendahuluan RM 10, tetapi si pembeli mempunyai hak untuk membatalkan pembeliannya jika didapati bahawa harga ramalannya tidak tercapai.

Jika syarat ini tidak dipatuhi maka kontrak itu tidak sah menurut Shariah kerana: Untuk pengetahuan pembaca, Islam tidak membenarkan aqad jual beli di meterai hari ini bagi transaksi pada masa akan datang; ia tidak sah menurut Perak.

Bagaimanapun pelaburan Swiss Mutual Fund ini sudah dalam lebih teruk lagi, kerana ia langsung tidak menggunakan kontrak pelaburan yang diurus menurut Shariah. Pastinya kontrak pelaburan seperti ini adalah batal menurut empat mazhab dan segala keuntungan yang diterima adalah tidak sah. Menurut Shariah, hanya dua jenis jaminan modal di izinkan dalam islam Mudarabah iaitu: Malangnya, kedua-dua perak tidak mufti dalam aqad pelaburan swiss.

Fixed deposit adalah satu jenis pelaburan yang menjamin pulangan atau keuntungan dalam bentuk yang perak ditentukan secara pasti sejak awal lagi.

Ia telah sepakat seluruh ulama sebagai haram kerana Riba. Syarikat seperti ini sememangnya amat diminati kerana pulangannya lumyaan seperti genting di Malaysia. Bagi sebarang pelaburan mufti luar Negara, semua syarikat yang dilabur sepatutnya mesti disemak samada ia diluluskan oleh Dow Jones Islamic atau tidak.
